The short version. Trucksys keeps your records and does arithmetic on them. It is your tool, not your accountant and not your lawyer. The figures are only as good as what you put in, and what you do with them is your call.
These terms are the agreement between you and Trucksys TMS, Detroit, Michigan. By making an account or using the software you accept them. If you do not accept them, do not use it.
Software for keeping your own trucking records — loads, miles, fuel, settlements, detention, documents — and checking them against what you are paid.
What it is not: it is not legal, tax, accounting or financial advice. It does not file anything for you, does not make a claim on your behalf, and does not represent you to a broker, a carrier or an agency. The escrow rule it refers to is 49 CFR 376.12(k); reading it to you is not advising you on it. If money is at stake, talk to an accountant or a lawyer.
It is also not an ELD. It does not record hours of service and it will not keep you compliant with the hours-of-service rules.
Trucksys is in beta. That means features change, features are added, and occasionally something breaks. We will not lose your records on purpose and we take backups, but during beta you should keep your own copies of anything you cannot afford to lose. Keep your original documents.
If a payment fails, we will tell you and give you a chance to fix it. If it stays unpaid, the account goes read-only: your records stay yours, stay readable, and can still be exported or deleted, but you cannot add new ones or change existing ones until it is settled.
Everything you put into Trucksys is yours. We claim no ownership of it. We hold it to run the service for you, we handle it as set out in the Privacy Policy, and you can have it back or have it deleted whenever you want — see Delete my data.
The software itself, the name and the design are ours.
The reader pulls figures off a photograph. It is good; it is not perfect. A smudged rate confirmation, a bad angle, a fax of a fax — any of them can produce a wrong number. Check what it fills in before you rely on it. Every field it fills is a field you can correct. We are not liable for a figure you did not check.
When you use it, the document is sent to Anthropic to be read. Do not use it on a document you are not allowed to send to a third party.
The trip, fuel and settlement calculators do arithmetic on the figures you give them. They estimate. Fuel price moves, mileage differs from what a broker paid on, tolls are not included unless you enter them, and a truck does not return the same MPG every week. A green light is a calculation, not a promise. The decision to take a load is yours.
We aim to keep Trucksys running and we watch it, but we do not promise a particular level of uptime during beta. We may take it down for maintenance and will give notice where we can.
You can close your account at any time from Delete my data or by writing to us.
We may suspend or close an account that breaks these terms, does not pay, or puts the service or other customers at risk. Except where the law or the conduct makes it impossible, we will give you notice and a chance to export your records first.
Trucksys is provided as is. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software is error-free or that its figures are accurate.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost loads or lost data. Our total liability for any claim is limited to what you paid us in the twelve months before the claim arose, or one hundred US dollars if you paid us nothing.
Some states do not allow these limits. Where that is so, they apply to you only as far as that state permits, and nothing here limits liability for our own fraud, or for anything else that cannot lawfully be limited.
If someone brings a claim against us because of how you used Trucksys, what you put into it, or because you broke these terms, you agree to cover our reasonable costs in dealing with it.
These terms are governed by the law of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts sitting in Wayne County, Michigan, and we both agree to those courts. Nothing here stops you bringing a claim in small claims court.
We may change these terms. The date at the top changes with them. If a change materially affects you we will email account holders at least 30 days before it takes effect, and continuing to use Trucksys after that is your acceptance. If you do not accept it, close the account and we will refund the unused part of the period you paid for.
If one part of these terms is unenforceable, the rest stands. Not enforcing something once does not waive it. These terms, with the Privacy Policy, are the whole agreement between us. You may not transfer this agreement; we may, if the business is sold, and we would tell you.
